1. GENERAL

1.1 These general terms and conditions apply to all services and products of Mariëlle Duijndam. The conditions are accessible to everyone and included on the website of Mariëlle Duijndam, located in Wapenveld.

1.2 By transferring a payment for a service or product, you agree to the delivery and payment conditions. Mariëlle Duijndam reserves the right to change its delivery and/or payment terms after the term has expired.

1.3 Unless otherwise agreed in writing, the general or specific terms and conditions or stipulations of third parties are not acknowledged by Mariëlle Duijndam.

1.4 Mariëlle Duijndam guarantees that the service or product delivered complies with the agreement and meets the specifications stated in the offer.

2. PRICES

2.1 Prices will not be increased within the term of the offer, unless legal measures make this necessary or if an intermediary increases the price.

2.2 All prices on the site are subject to typographical errors. No liability is accepted for the consequences of typing errors.

2.3 All prices on the site are in euros and exclude VAT, unless stated otherwise (21% for services and most products).

3. QUOTATIONS

3.1 Quotations from Mariëlle Duijndam are valid for 30 days. The conditions can then be adjusted.

4. PAYMENT AND ABSENCE

4.1 Services and products of Mariëlle Duijndam must be paid in advance or in installments.

4.2 For services provided on an invoice basis, a payment term of 7 or 14 days applies.

4.3 If the client does not pay within the specified period, Mariëlle Duijndam has the right to ensure that the client can no longer use her services. Even if the client may no longer be able to use the service, he will in any case still have to meet the payment obligation for outstanding invoices.

4.4 When the client has fulfilled all obligations, he will be able to use all services of Mariëlle Duijndam if there is a good relationship.

5. DELIVERY AND RETURNS

5.1 Delivery of online services and products takes place immediately. If technical problems arise, the client must inform Mariëlle Duijndam of this and Mariëlle Duijndam will ensure that the delivery will still take place as agreed.

5.2 Online services and downloadable products are non-returnable and no refunds will be given as long as Mariëlle Duijndam meets the specifications stated in the offer.

6. INTELLECTUAL PROPERTY

6.1 All services and products offered by Mariëlle Duijndam fall under her intellectual property. The customer may only use this information for the purpose for which it was provided to the customer, not reproduce it and not change or delete the copyright, brand name, design, trade name and other indications.

6.2 Mariëlle Duijndam reserves the right to use the knowledge acquired during the performance of the work for other purposes, provided that no confidential information is disclosed to third parties.

7. PRIVACY AND CONFIDENTIALITY

7.1 Personal information and information obtained about the client will not be shared by Mariëlle Duijndam with third parties, unless the client has given written permission for this.

7.2 By participating, participants in Mariëlle Duijndam's services also declare confidentiality with regard to all information they obtain about Mariëlle Duijndam and other participants. This information is confidential and must be treated as such to ensure a secure environment.

8. CANCELLATION

8.1 Mariëlle Duijndam has the right to cancel the service without giving reasons or to refuse the participation of a client or to refuse the person designated by the client, in which case the client is entitled to a refund of the entire amount paid to Mariëlle Duijndam with deduction from the services provided until termination.

8.2 A service without an overnight stay can be canceled or rescheduled free of charge up to 48 hours before the start of the appointment. In case of cancellation or rescheduling within 48 hours, Mariëlle Duijndam is entitled to charge the full agreed rate for the service. Failed appointments will be charged in full. If the client is not present or leaves after the start, a refund of the amount paid is not possible.

8.3 If you cancel an overnight service, such as a multi-day retreat, there will be no refund. Participation can be rescheduled by the client to another retreat or date, which will take place within 1 year after written notice of cancellation and notification of Mariëlle Duijndam. It is also possible to transfer participation to someone else and arrange this mutually, provided Mariëlle Duijndam is informed of this in a timely manner.

8.4 Any form of membership can be canceled independently at any time. Amounts already paid will not be refunded. The cancellation applies to the next direct debit amount. If it concerns payment in installments for a fixed period, all installments must be paid.

9. LIABILITY

9.1 Clients are fully responsible for their personal health and well-being. Services and products from Mariëlle Duijndam are purely intended to support personal development and should be used in this way.

9.2 Any liability of Mariëlle Duijndam for personal damage, business damage or other indirect damage or consequential damage, of whatever nature, is explicitly excluded.

10. CHANGE OF CONDITIONS

These conditions can be changed by means of a simple notification from Mariëlle Duijndam to the client. In the absence of a protest within 30 days after notification, the amended terms and conditions will apply to all new agreements from the date of notification as well as to all outstanding agreements to the extent that they are executed after the day of notification.
